Members of the OAS LGBTI Core Group welcome Advisory Opinion 24/17 of the Inter-American Court of Human Rights on LGBTI Rights

Argentina, Brazil, Canada, Chile, Colombia, Mexico and Uruguay, as members of the OAS LGBTI Core Group, welcome the Advisory Opinion of the Inter-American Court of Human Rights reiterating that sexual orientation and gender identity are protected categories under the American Convention on Human Rights and affirming that States have the responsibility to recognize, guarantee and protect the rights that derive from a family bond between persons of the same sex.

The Court’s Opinion constitutes a valuable contribution to the jurisprudence of the Inter-American Human Rights System, as it reminds States of their obligations regarding guaranteeing and protecting the rights of LGBTI persons across the region.

Furthermore, the Court understood that a person’s full autonomy to establish a permanent and marital bond is derived from the principle of human dignity, and that such a bond deserves equal rights and protection regardless of the sexual orientation of the parties.

Likewise, the Advisory Opinion reaffirms the rights of transgender people by affirming that the change of name, image adjustment, as well as the rectification of sex or gender references, in registers and in identity documents so that these are consistent with self-perceived gender identity, is a right protected by the American Convention. As a consequence, States are obliged to recognize, regulate and establish the appropriate procedures for such purposes.

Without prejudice to the sovereign right of all States to adopt policies and legislation in a progressive manner and to evolve on this matter at their own pace, we agree with the Court’s view that lack of consensus on respecting the rights of certain groups that are characterized by their sexual orientation or their gender identity or expression cannot be considered a reason to deny or restrict their human rights or perpetuate historical or structural discrimination against them.

The afore-mentioned members of the Core Group are optimistic that this Advisory Opinion will provide elements for States to drive legislative, administrative and public policy reforms through which progress is made in the protection and guarantee, under equal conditions, of the rights of LGBTI people.


Miembros del Core Group LGBTI de la OEA celebran la Opinión Consultiva 24/17 de la Corte Interamericana de Derechos Humanos sobre derechos LGBTI

Argentina, Brasil, Canadá, Chile, Colombia, México y Uruguay, como miembros del Core Group LGBTI de la OEA, celebran la Opinión Consultiva de la Corte Interamericana de Derechos Humanos en la que reitera que la orientación sexual y la identidad de género son categorías protegidas bajo la Convención Americana de Derechos Humanos y afirma que los Estados tienen la responsabilidad de reconocer, garantizar y proteger los derechos derivados de la unión familiar entre personas del mismo sexo.

La Opinión de la Corte constituye un valioso aporte a la jurisprudencia del Sistema Interamericano de Derechos Humanos, ya que recuerda a los Estados acerca de sus obligaciones en materia de garantía y protección de los derechos de las personas LGBTI en toda la región.

Además, la Corte entendió que la plena autonomía de la persona para establecer un vínculo permanente y marital deriva del principio de dignidad humana, y que dicho vínculo merece igualdad de derechos y protección sin importar la orientación sexual de los contrayentes.

Asimismo, la Opinión Consultiva reafirma los derechos de las personas transgénero al afirmar que el cambio de nombre, la adecuación de la imagen, así como la rectificación a la mención del sexo o género, en los registros y en los documentos de identidad para que estos sean acordes a la identidad de género auto-percibida, es un derecho protegido por la Convención Americana. Como consecuencia, los Estados están en la obligación de reconocer, regular, y establecer los procedimientos adecuados para tales fines.

Sin perjuicio del derecho soberano que asiste a todos los Estados de adoptar las políticas y legislaciones de manera progresiva y de evolucionar en esta materia a su propio ritmo, estamos de acuerdo con lo aludido por la Corte de que la falta de consenso sobre el respeto de los derechos de ciertos grupos que se definen por su orientación sexual o identidad y/o expresión de género no puede ser considerada una razón para negar o restringir sus derechos humanos o perpetuar la discriminación histórica o estructural contra ellos

Los miembros del Core Group mencionados anteriormente son optimistas de que esta Opinión Consultiva brindará elementos para que los Estados impulsen reformas legislativas, administrativas y de políticas públicas a través de las cuales se avance en la protección y garantía plena, y en igualdad de condiciones, de los derechos de las personas LGBTI.
