Adoption and surrogacy

Birth abroad

If your child is born outside of Canada, you do not need to register the birth in Canada.

The birth of every child in Romania, legitimate or natural, must be registered with the local authorities. Registration must occur within maximum 30 days following the birth.

Information, for guidance purposes, can be found on the Directorate for Persons Record and Civil Status Documents Sector 1, Bucharest (only in Romanian).

Fingerprints in Romania

If you are a Canadian citizen, please contact the Romanian Police in order to find out how to get your fingerprints taken.

Authentication of criminal record checks (police clearance) or fingerprint certificates

The institution asking for your criminal record check or fingerprint certificate may also request that it be authenticated. The Embassy of Canada to Romania cannot authenticate these documents.

All criminal record checks, fingerprint certificates and documents originating from any local or provincial police station in Canada must first be notarized by a Canadian notary or a Commissioner of Oaths prior to authentication.

The Authentication and Service of Documents Section (JLAC) will issue a certified true copy of the notarized document, which is accepted by some requesting institutions. Verify if the one you’re applying with will accept a certified true copy.

Documents issued by the RCMP do not need to be notarized prior to being authenticated by JLAC. If you need an authenticated original document, you must first request the police clearance from the RCMP and then submit it for authentication.

Processing times

It can take up to 3 business days from the time we receive your documents and fees. The processing time can take longer if we have questions about your documents or need additional verifications.

Processing times may change without notice. If you are making travel plans, you should not book the trip before you get your documents.

Death abroad

Refer to Death outside Canada.

In Romania, registration of death is obligatory and must be done within 24 hours at the in the city or town where the death occurred. A death certificate is normally issued within 72 hours, except in case of violent or suspicious death.

In the case of a violent death (e.g. accident, suicide), the Prosecutor or the criminal police officer, assisted by a coroner, must file a report specifying:

  • the condition of the body
  • the related circumstances surrounding the death
  • the deceased's personal information (name, place and date of birth, profession and residence)

The Prosecutor will provide the information contained in the report to the Directorate for Persons Record and Civil Status Documents where the person died, in order to file a death certificate.

An autopsy is normally performed, including when the death occurs in a hospital.

Marriage abroad

Marriages are never celebrated at the Embassy. The Embassy of Canada to Romania does not assist with marriage arrangements.

Religious marriages in Romania cannot be performed until after the civil ceremony.

Contact the local Municipality where the marriage will be performed for further instructions.

Romanian law requires Canadian citizens to present a "Certificat de Coutume" (Certificate of Non-Impediment to Marriage) that certifies their capacity to marry. The Government of Canada does not issue "Certificats de coutume". However, to assist Canadians to meet the local requirements, the Embassy of Canada issues an affidavit (PDF) containing the relevant information.

Make an appointment with the Embassy of Canada to Romania to bring:

  • the completed affidavit
  • original or certified true copy of own valid Canadian passport
  • original or certified copy of the fiancé(e)’s valid passport or local identity card

If you and your fiancé(e) are both Canadian citizens, you will each need to swear an affidavit. Non-refundable fees will apply for each of you. See fees under Notarial services.

Our service standard is 3 business days from the time we receive a complete affidavit.

Marriages that are legally performed in a foreign country are usually valid in Canada, and you do not need to register them in Canada. If you have questions about the validity of your foreign marriage, contact the Vital Statistics Office of your province or territory.

Notarial services

Canadian consular officials abroad have authority under the Canada Evidence Act and corresponding provincial and territorial statutes to perform a variety of notarial services. These services are offered, however, only when no local service providers exist and by appointment only.

A list of local lawyers, notaries and doctors are available at Ask Travel or by contacting the Embassy of Canada to Romania by email at bucst.consular@international.gc.ca. Notaries across Romania can be found on the website of The National Union of Notaries Public from Romania.

Notarial services are primarily for the benefit of Canadian citizens; they may also be provided to non-Canadian citizens, if the documents are intended to be used in Canada.

Consular officers are not notaries, nor are they commissioners of oaths, lawyers, etc. Clients seeking further information on notarial services abroad can refer to Notarial services.

The Embassy of Canada can provide notarial services (fees apply) such as:

  • certify true copies of some documents that meet strict requirements;
  • administer oaths and affirmations;
  • witnessing a signature on a document;
  • notarize certain documents if they are intended for use in Canada.

Canadian government officials abroad cannot:

  • draft or modify legal/notarial documents;
  • verify the identity of a Canadian on behalf of a third party;
  • stamp documents to confirm they have been “seen” at a Canadian government office abroad;
  • certify the genuineness, legality or credibility of documents;
  • assess legal documents or provide advice on their content, validity or any other aspect;
  • authenticate documents that require a consular officer to act as an agent for another entity;
  • authenticate documents containing content that may be misleading or used for fraudulent purposes;
  • issue a certificate that confirms marital status, non-impediment, or freedom to marry, abroad or in Canada;
  • issue a certificate indicating that a foreign divorce will be recognized in Canada.

Oaths, affirmations, statutory declarations and witnessing signatures

The statutory declarations and affidavits are only accepted in one of the two official languages of Canada. These documents must be reviewed by a consular officer before the service can be done.

Send an e-mail to bucst.consular@international.gc.ca and attach the document(s) that require our signature for our review and explain your request. After reviewing the document, we will contact you to confirm whether we can provide you with this notarial service. A stamp stating that the Embassy does not validate the content of the document will be added.

The service on affidavits and statutory declarations may only be provided in person, as clients must sign the document(s) before a consular officer.

Certified true copies

A certified copy does not validate the content of the original document or the copy and a non-validation stamp will be applied, on original or copies of Governmental issued documents such as Canadian passports, birth certificates, marriage certificates, diplomas, transcripts, police records, etc. Citizenship Cards/Certificates will not be certified as true copies.

The Embassy of Canada may certify a true copy if the original document is provided and the following conditions are met:

  • The document is in English or French, or is accompanied by an official English or French translation.
  • The client is a Canadian citizen or the document is to be used in Canada.
  • The consular officer is familiar with the format of the original document.

Authentication of Canadian documents

Authentication (sometimes also referred to as “legalization”) is the certification of the genuineness of the signature and seal of an official. Through this process, it is attested that the official has the authority to execute, issue or certify a document in one jurisdiction, so that it may be recognized in another jurisdiction. Authentication does not certify the genuineness, legality or credibility of the documents or their contents.

Authentication of Canadian documents for Use in Romania

Canadian documents for use in Romania must be authenticated through diplomatic channels.

The Embassy can apply its seal on your Canadian document only if it has been previously authenticated by Global Affairs Canada (GAC) in Ottawa. The non-validation of the content stamp will be added since the Embassy will only certify the genuineness of the signature and seal of the GAC official.

Once authenticated by GAC, have the signature authenticated by the Romanian Embassy in Ottawa or one of its Consulates in Canada.
