Update - June 29, 2020: Goods classified under heading 96.19 that are of textile material other than wadding are added to the definition of tariff preference level apparel goods.
This Notice sets out the policies and practices pertaining to the administration of tariff preference level (TPL) goods for import from the United States and Mexico under the Canada-United States-Mexico Agreement (CUSMA) including: 1) wool and cotton or man-made fibre apparel; 2) cotton or man-made fibre fabrics and made-up goods; and 3) cotton or man-made fibre spun yarn.
This Notice, effective July 1, 2020, is provided pursuant to the authority of the Export and Import Permits Act (EIPA) and its corresponding regulations, and remains in effect until further notice.

1. Definitions
Tariff Preference Levels (TPL): special CUSMA provisions set out in Chapter 6, Annex 6-A, Section C Preferential Tariff Treatment for Non-Originating Goods of another Party, of the CUSMA that provide for the application of CUSMA preferential tariffs for imports and exports of non-originating textile and apparel goods, up to a specified quantity.
Non-originating good: a good that does not meet the rules of origin of the agreement.
TPL-eligible apparel goods:
- wool or cotton or man-made fibre apparel of Chapters 61 and 62, and goods classified under heading 96.19 that are of textile material other than wadding, of the Harmonized System (HS) that are both cut (or knit to shape) and sewn or otherwise assembled in the United States or Mexico from fabric or yarn produced or obtained outside the free trade area, as described in Chapter 6, Annex 6-A Special Provisions, Section C: Preferential Tariff Treatment for Non-Originating Goods of another Party of CUSMA.
TPL-eligible cotton or man-made fibre fabrics and made-up goods:
- cotton or man-made fibre goods of Chapters 52 through 55, 58, 60, and 63 (excluding goods containing 36% or more by weight of wool or fine animal hair) of the HS that are woven or knit in the United States or Mexico from yarn produced or obtained outside the free trade area or yarn produced in the free trade area from fibre produced or obtained outside the free trade area, or knit in the free trade area from yarn spun in the free trade area from fibre produced or obtained outside the free trade area; and
- cotton or man-made fibre goods of subheading 9404.90 that are finished and cut and sewn or otherwise assembled in the United States or Mexico from fabrics of subheadings as indicated in Chapter 6, Annex 6-A Special Provisions, Section C: Preferential Tariff Treatment for Non-Originating Goods of another Party of CUSMA, produced or obtained outside the free trade area.
- Imports from the United States into Canada are limited to goods of Chapter 60 or heading 63.03 of the HS.
TPL-eligible cotton or man-made fibre spun yarn:
- cotton or man-made fibre spun yarns of heading 52.05 through 52.07 or 55.09 through 55.11 that are spun in the United States or Mexico from fibre of heading 52.01 through 52.03 or 55.01 through 55.07, produced or obtained outside the free trade area, as described in Chapter 6, Annex 6-A Special Provisions, Section C: Preferential Tariff Treatment for Non-Originating Goods of another Party of CUSMA; and
- for imports from the United States, metalized yarn of heading 56.05 that are formed in the United States from fibres obtained outside the free trade area.

2. Eligibility criteria
- Any resident of Canada is eligible to apply for a shipment-specific permit for imports of TPL-eligible goods to the United States or Mexico.
3. Administration policy
- Shipment-specific import permits are required for imports of these goods in order to obtain the preferential tariff rate under CUSMA.
- Shipment-specific import permits are available for imports of TPL-eligible goods on a first-come, first-served basis, upon submission of a duly completed shipment-specific permit application.
- Once a tariff preference level quota has been fully utilized, import permits will not be issued.
- Imports of TPL-eligible goods from Mexico must be accompanied by a Certificate of Eligibility issued by the Government of Mexico.
- For year 1 of CUSMA implementation, the TPL levels are not pro-rated and the full quota quantities are accessible for imports.
