Canada commends Tunisia for the adoption of the organic law on the elimination of violence against women, the adoption of a decree allowing Tunisian women to marry non-Muslim men, and the adoption of the organic law on the elimination of all forms of racial discrimination.

Canada recommends that Tunisia: 

  1. Revise the Code of Military Justice and other relevant legislation to prohibit the trial of civilians in military courts.
  2. Repeal Article 230 of the Penal Code which criminalizes sexual relations between consenting adults and eliminate discriminatory practices based on sexual orientation and gender identity.
  3. Repeal the 1978 Decree regulating the state of emergency and the 1975 Decree establishing the powers of the Ministry of the Interior, or revise them to remove their freedom-restricting provisions.
  4. Amend Orientation Law n°2005-83 in order to rectify the definition of disability and integrate a human rights approach.

Canada encourages Tunisia to preserve the gains of the 2011 Revolution, including Decree-Law No. 2011-88 on the organization of associations, and to ensure a balance of power. Canada also encourages Tunisia to guarantee freedom of religion and conscience.
