1.0 Purpose

1.1 The purpose of this Notice is to inform importers of the July 29, 2011 Order Amending the Import Control List and Repealing the European Union Surtax Order.  Item 194 – frozen pork from the European Union as specified in the Surtax Order has been removed from the Import Control List, and the European Union Surtax Order has been repealed.

2.0 Coverage

2.1 This Notice replaces Notice to Importers No. 790 dated June 7, 2011 and refers to item 194 of the Import Control List (ICL). This item covers frozen meat of pork, falling under tariff item No. 0203.29.00 of the Customs Tariff.

3.0 Authority

3.1 His Excellency the Governor General in Council, on the recommendation of the Minister of Finance and the Minister of Foreign Affairs, pursuant to sections 53 and 79 of the Customs Tariff, has authorized effective July 29, 2011 the Order Amending the Import Control List and Repealing the European Union Surtax Order (P.C. 2011-831 July 29, 2011).

4.0 Import Permit Issuance

4.1 With the removal of item 194 from Import Control List and repeal of the European union surtax order, Foreign Affairs and International Trade Canada will no longer require import permits for imports of frozen meat of pork, falling under tariff item no. 0203.29.00, and Canada Border Services Agency will no longer be applying the surtax.

4.2 Importers are reminded that removal of the requirement for import permits does not relieve them of other legal requirements pertaining to importation, such as those imposed by Canada Border Services Agency and the Canadian Food Inspection Agency.

5.0 Import Access Level

5.1 A tariff rate quota level no longer applies for frozen meat of pork, covering imports that originate in Austria, Belgium, Denmark, Finland, France, Federal Republic of Germany, Greece, Ireland, Italy, Luxembourg, the Netherlands, Portugal, Spain, Sweden or the United Kingdom of Great Britain and Northern Ireland.
