CPTPP: Broiler Hatching Eggs and Chicks for Chicken Production TRQ - Serial No. 951

This Notice replaces Notice to Importers No. 914 dated November 26, 2018 and sets out the policies and practices pertaining to the administration of Canada’s tariff rate quota (TRQ) for broiler hatching eggs and chicks for chicken production under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).
This Notice is provided pursuant to the authority of the Export and Import Permits Act (EIPA) and its corresponding regulations, and remains in effect until further notice.

1. Definitions
Chick for chicken production means a product that is included in item 94 on the Import Control List (ICL), namely live broilers for domestic production, being fowls of the species Gallus domesticus, weighing not more than 185 grams, that are classified under tariff item No. 0105.11.21 or 0105.11.22 in the list of tariff provisions set out in the Schedule to the Customs Tariff.
Hatching egg means a product that is included in item 95 on the Import Control List (ICL), namely hatching eggs, for broilers, of fowls of the species Gallus domesticus, that are classified under tariff item No. 0407.11.11 or 0407.11.12 in the list of tariff provisions set out in the Schedule to the Customs Tariff.
Hatching egg other than for broiler means a product that is included in item 135 on the Import Control List (ICL), namely hatching eggs other than for broiler, of fowls of the species Gallus domesticus, that are classified under tariff item No. 0407.11.91 or 0407.11.92 in the list of tariff provisions set out in the Schedule to the Customs Tariff.
2. Allocation policy
- To be eligible to apply, you must be active in the Canadian broiler hatching sector at the time of application, and must remain active during the upcoming quota year.
- All applicants must provide a list of related persons.
- You may convert any portion of your broiler hatching egg allocation into an egg-equivalent (EE) allocation for chick imports at a conversion rate of 1.27 broiler hatching eggs for one chick.
- You must specify in your application the minimum amount of quota you will accept. If your calculated allocation is less than 25,000 dozen, you are issued an allocation only if the quantity you have specified in your application is equal to or lower than your calculated allocation.
- There are no quantitative restrictions on imports of hatching eggs other than for broiler, and permits for these products are issued on demand.
3. Eligibility criteria
You are eligible to apply for an allocation if you are a:
Canadian Food Inspection Agency (CFIA) licensed hatchery:
- You must exclude the following products from your application:
- any chick that was not hatched in your own CFIA licensed hatchery in the reference period; or
- any chick hatched in another hatchery for you under a subcontract in the reference period, and which is included in the application of the hatchery that hatched the egg.
4. Calculation of allocations
Canadian Food Inspection Agency (CFIA) licensed hatchery:
- 100% is allocated to CFIA licensed hatcheries on a market share basis based on the total number of chicks hatched by the hatchery during the reference period.
5. Transfer, return and under-utilization of allocations
- If you wish to transfer any portion of your allocation, you must submit a transfer request form.
- You may return any portion of your allocation to the Department in writing by the prescribed return date.
- Note: Returned quantities are normally made available seven days after the return date to eligible allocation holders, who have not returned any quantity of their allocation, in proportion to their initial allocation, or on demand if quantities remain after the first offer.
- If you use less than 90% of your allocation in one year, you may have your allocation adjusted downward by an under-utilization penalty (calculated in egg equivalents) in the following year.
- Note: Any portion of your allocation that you transfer or return in accordance with the present policy is considered to have been used.
